Buenos Aires, 27 noviembre (NA) — El juicio laboral contra el restaurante Piegari que deriv\u00f3 en una condena por $200 millones de pesos expuso un esquema de fraude salarial que omit\u00eda registrar la mayor parte del ingreso del mozo, incluso el m\u00ednimo legal obligatorio para el rubro.<\/p>\n

Seg\u00fan supo la Agencia Noticias Argentinas, el mozo, que trabaj\u00f3 26 a\u00f1os en el sal\u00f3n, denunci\u00f3 que en marzo de 2020 su ingreso real era de $100.000 ARS; sin embargo, solo $40.000 ARS figuraban registrados \u00aben blanco\u00bb.<\/p>\n

LA BRECHA ENTRE EL CCT Y EL PAGO REAL<\/p>\n

Al cotejar el salario con el Acuerdo Salarial 2019 de UTHGRA (CCT 389\/04) vigente para esa \u00e9poca, el fraude se hace evidente:<\/p>\n

* Sueldo B\u00e1sico Legal (Marzo 2020): El b\u00e1sico legal para un Mozo de Sal\u00f3n (Categor\u00eda 6, Restaurantes 4 Tenedores A) era de $33.647 ARS.
\n * Adicionales Obligatorios: A este b\u00e1sico deb\u00edan sumarse porcentajes fijos por Complemento de Servicio (12%), Plus CABA (6%) y, de manera crucial, la antig\u00fcedad del trabajador (26 a\u00f1os), lo que aumentaba sustancialmente la cifra base.<\/p>\n

La empresa registraba una suma total de $40.000 ARS, que apenas cubr\u00eda la suma del b\u00e1sico m\u00e1s algunos adicionales. No obstante, la mayor parte del salario real se pagaba en negro: los $60.000 ARS restantes (el 60% de su ingreso total) eran propinas y pagos \u00abde bolsillo\u00bb.<\/p>\n

EL COSTO DE LA MALA REGISTRACI\u00d3N<\/p>\n

La sentencia determin\u00f3 que la falta de registraci\u00f3n del ingreso real del trabajador durante 26 a\u00f1os implic\u00f3 una deficiencia grave en los aportes previsionales y de obra social.<\/p>\n

La jueza, al ratificar el despido indirecto, incluy\u00f3 el ingreso real de $100.000 ARS como base para el c\u00e1lculo de indemnizaciones. Esta acci\u00f3n, sumada a las multas por la mala registraci\u00f3n y la duplicaci\u00f3n de la indemnizaci\u00f3n por el Decreto 34\/2019, dispar\u00f3 la condena a los $200 millones de pesos que ahora la empresa apela.<\/p>\n
